Copyright and AI rights
Copyright and usage rights
The original photographs, videos, texts and other protected work on this website are protected by copyright and related rights. Unless otherwise stated, the rights holder is Sascha van der Werf. Rights in identified third-party content remain with their respective holders.
Unless statutory permission or a valid existing licence applies, my written consent must be obtained before use; clear consent by email is sufficient for this purpose. This applies in particular to reproduction, publication, commercial use, adaptation and distribution. Permitted uses are governed by the scope specifically agreed. Public availability, downloading or attribution alone does not grant a licence. Technical display necessary for ordinary intended browsing of the website remains permitted.
Without appropriate permission, my protected work must not, in particular, be uploaded into AI systems as reference, input or editing images, used for face swaps, style transfers or other AI manipulation, or used to create derivative images insofar as this engages my rights. Uses permitted by law remain unaffected. This notice does not establish an exclusive right in an abstract style, general idea or method as such.
Express reservation for text and data mining / AI training
For my own protected content, I expressly prohibit reproduction for text and data mining within section 42h(6) of the Austrian Copyright Act and reserve the corresponding rights. This also covers creating and using AI training or evaluation datasets to the extent that those activities fall within this reservation. Such use requires my express prior written consent unless a statutory permission that cannot be excluded applies.
Mandatory statutory exceptions remain unaffected, particularly privileged scientific and artistic research under section 42h(1)–(5) of the Austrian Copyright Act, subject to its legal requirements. This also includes certain non-commercial research by individual researchers. Other applicable statutory permissions likewise remain unaffected. Merely describing an activity as research does not establish that its legal requirements are met.
Editing, attribution and sharing
Licensed uses are subject to the agreed editing and credit requirements. Without appropriate permission, alterations of image content, cropping that changes meaning, text overlays and distortive changes of context are prohibited insofar as protected rights are affected. This does not generally exclude purely technical adjustments necessary for an expressly permitted use and covered by its agreed purpose.
Unless otherwise agreed, where the particular use requires attribution, the credit is “Photo: Sascha van der Werf” with a reference to van-der-werf.com. Social-media use should link the actual account agreed in the offer. Attribution does not replace permission. Under this notice, omission of a credit does not automatically and retrospectively extinguish all usage rights.
A licence does not include sublicensing or sharing for independent use by third parties unless agreed. Necessary technical providers may act within the agreed purpose without acquiring their own exploitation rights. Resale of physical originals or copies that is permitted by law remains unaffected.
Trademarks, links and external services
Named trademarks and signs belong to their respective rights holders. Mentioning them alone does not imply a partnership, endorsement or support by those businesses. This also applies to linked social-media profiles, providers and academy offerings.
External links lead to content controlled by others. I check linked content with reasonable care; this is not a promise to monitor third-party websites continuously and comprehensively. If you report a potentially unlawful link, I will review it and take necessary action. My own statutory responsibilities and mandatory liability are not excluded.
Print and room visualisations
Room and print mockups are illustrative. Scale, colours and presentation may differ from the actual item. The expressly agreed characteristics of the specific offer are binding; legally relevant public product statements must also be taken into account. Frames, furniture and decorations are included only where expressly stated. A visualisation does not replace accurate dimensions, materials and information on what is supplied.
